Terms of Service

These Terms govern your use of SkySignal (the “Service”), operated by SkyL4rk (Pty) Ltd (“we”, “us”). By creating an account or using the Service, you agree to them. If you are using the Service for an organisation, you confirm you are authorised to bind it.

1. The Service

The Service lets you create, schedule, publish and report on email and social media campaigns, including connecting third-party social accounts and managing campaign assets. We may change, add or remove features over time.

2. Accounts

You must provide accurate information, keep your credentials secure, and are responsible for activity under your account. Each workspace’s data is scoped to the people you grant access. Tell us promptly of any unauthorised use.

3. Your content

You retain all rights in the content you create, upload or reference (“Your Content”) — copy, images, links, recipient lists and the like. You grant us a limited licence to host, process, transmit and publish Your Content solely to operate the Service on your instruction (including sending it to the email and social platforms you select).

You are responsible for Your Content. In particular you warrant that:

4. Connected social accounts

When you connect a third-party platform (for example Facebook or LinkedIn), you authorise us to publish and manage content there on your behalf. Your use of those platforms is also governed by their own terms, and we are not responsible for their availability, decisions or handling of content once published. Content you publish to a platform is held by that platform under its own policies, and may persist there even after you delete it from the Service.

5. Acceptable use

You agree not to use the Service to send spam or unsolicited bulk messages, to publish unlawful, infringing, hateful or deceptive content, to attempt to breach security or access data that is not yours, or to circumvent platform rules or rate limits. A fuller Acceptable Use Policy may supplement these Terms.

6. Fees

Fees are payable as described at sign-up. We may change fees on reasonable notice.

7. Availability

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. Scheduled publishing depends on third-party platforms and on assets you host remaining reachable at the time of sending; we are not liable for failures caused by those external factors.

8. Warranties & liability

The Service is provided “as is” to the extent permitted by law, without implied warranties. Nothing in these Terms excludes liability that cannot lawfully be excluded. Subject to that, we are not liable for indirect or consequential loss, and our total liability arising from the Service is limited to.

9. Indemnity

You will indemnify us against claims arising from Your Content or your breach of these Terms, including claims that Your Content infringes a third party’s rights.

10. Suspension & termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or to comply with law. On termination, your data is handled as described in the Privacy Policy and DPA.

11. Changes

We may update these Terms. Material changes will be notified in-app or by email, and continued use after they take effect means you accept them.

12. Governing law

These Terms are governed by the laws of the Republic of South Africa, and disputes are subject to the courts of the Republic of South Africa.
